This privacy statement explains the personal data SHOWFA Limited (“SHOWFA”) collects, processes, and for what purposes the data is used.
Our App is designed and propagated in such a way that explains the information that is collected and how it will be used to provide our services and give our clients the best experience and safety of their data.
A. Identification information data processed.
Sensitive data such as personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs; trade-union membership; genetic data, biometric data processed solely to identify a human being; health-related data; data concerning a person’s sex life or sexual orientation is not in any way collected, stored, or handled by Showfa Limited.
Personal and Anonymous Information
“Personal information” is that which can be used to contact or identify you, such as full name, email address, phone number, Geo-location of the passenger, the time and the destination of a journey, Geo-location of drivers and driving routes, payment method, billing information, profile picture, information about the vehicle (the registration number, model, year of manufacture and colour of the vehicle), driver's license data as well as information that is linked to such information.
“Anonymous Information” is data that when collected cannot directly or indirectly identify a person. It includes passively collected information about your activities on the Service, such as usage data, to the extent that information is not linked to your Personal Information.
Access and browsing certain portions of our Service is permissible without disclosing Personal Information; however, certain information is passively collected from your devices, such as your IP address, browser information, unique device identifier (“UDID”) and mobile operating system. Please note that one can choose not to provide certain information, but this will limit the features of the Service you can access and use. In order to utilize the Service, you must register with SHOWFA through the App.
1. Voluntary submitted information
As a user of Showfa there is certain information provided during your use of our service that is collected; this includes:
Personal Information entered when registering for the Service, e.g., full name, email address, active phone number, payment method, billing information, profile picture, information about the vehicle (the registration number, model, year of manufacture, and colour of the vehicle) and driver’s license data.
Information you provided in profile preferences, to customer support services, or that one posts on any forums or message boards in the App.
2. Information collected through use of the Service.
i. Location data: when you access the Service through a mobile device, we may access, collect, monitor, and/or remotely store “location data,” which may include the GPS coordinates of your trip (including pick-up and drop-off data) or similar information regarding the location of your mobile device.
ii. Transacting data: We collect information that is created real-time during your various interactions with the Service, including the date and time of a ride booked through the Service (“Ride”), the distance of the Ride, and the amount charged.
3. Information accessed through technology
When using SHOWFA Website with a device other than mobile, such information is collected, including the hardware model, browser type, operating system, Internet Protocol (IP), and domain name.
This information shall be correlated with other Personal information SHOWFA has about you. Cookies and URL information are also used to gather information regarding the time and date you used the Service and the information for which you searched and accessed the Showfa Website.
Session Cookies are those which expire once you close your web browser, and persistent Cookies are the ones that stay on your device until you delete them and may be used to provide you with a more personal and interactive experience. Persistent Cookies can be removed by following general web browser help file directions. The App and the Website are designed to learn and improve user experience by collecting user data.
4. Anonymous Information
Aggregated Anonymous Information is the combination of client Anonymous Information with the Anonymous Information of other Riders (“Aggregated Anonymous Information”). Aggregated Anonymous Information does not allow a client to be identified or contacted. We may share such Aggregated Anonymous Information with third parties, and, depending on the circumstances, we may or may not charge third parties for such information, or limit the third parties’ use of the same.
We may use Anonymous Information for the following purposes:
Improve the user experience on Website, App and Service and further customize your experience, such as by providing targeted useful features and promotions based on the type of services you seek or use more often.
Aggregate the information collected via cookies and similar technologies to use in statistical analysis to help track trends, evaluate the effectiveness of ads and analyse patterns.
5. Third Party information
We collect information that Riders and Drivers provide about one another, including via ratings, complaints, tips and reporting on lost and found items, postings on forums or message boards in the App.
Only persons above 18 years can be Riders. SHOWFA Services are not directed at or intended for anyone under 18 years of age. We do not knowingly collect nor solicit Personal Information from individuals under 18 years of age and no one under age 18 may provide any Personal Information to SHOWFA. If we later obtain actual knowledge that a Rider is under 18 years of age, we will take steps to remove that individual’s Personal Information from our systems and delete the account. If you are the parent or guardian of a child whom you believe has disclosed Personal Information to us, please contact us at firstname.lastname@example.org so that we may delete and remove such information from our systems.
B. Use of Personal Information
We may use and analyse your information for the following purposes:
1. For the registration and administration of the user’s account.
2. To Provide and for maintenance of the Service.
3. For smoother and more efficient communications between Riders and Drivers.
4. Send communications and administrative emails about the Service and reply to your inquiries.
5. Offer customer care support and diagnosis of technical and service problems.
6. Provide the users with advertising materials that are customised and may be based on your prior activity online.
7. Personalize and tailor the features, performance, and support to the users of the Website, App, and Service.
8. Send you promotional/marketing information, newsletters, offers or other information from us or on behalf of our third-party sponsors or partners.
9. Offer you the availability to participate in market surveys, social experiments, special events, and programs.
10. Provide you with opportunities and functionality that we think would be of particular interest to you.
11. Improving the existing products and services offered by Showfa.
12. Improving of the safety, security, and quality of the Website, App, and Service and performing internal operations.
13. Analyze use of both Riders and Drivers to improve the interaction between the two parties.
14. For the performance of accounting, auditing, and other corporate procedures relevant to Showfa.
15. Prevention of identify fraud, crimes, and other unlawful activity that may affect users of Showfa.
16. To allow Showfa to comply with and enforce all applicable legal requirements, relevant industry standards, and our policies or as requested by regulators, government entities, and official inquiries.
C. Disclosure of Information
We may disclose your information to:
a) Law-enforcement agencies, regulatory authorities, courts, or other statutory authorities in response to a demand issued with the appropriate lawful mandate and where the form and scope of the demand is compliant with the law.
b) publicly available and/or restricted government databases to verify your identity information in order to comply with regulatory requirements;
c) Emergency service providers when you make an emergency call (or where such disclosure to emergency service providers is necessary for your rescue, health, and safety), including your approximate location;
d) Any other person we deem legitimately necessary to share the data with.
We shall not release any information to any individual or entity that is acting beyond its legal mandate.
We will get your express consent before we share your personal data with any third party for direct marketing purposes.
1. Riders and Drivers
We share certain information about Riders (e.g., name, rating, pick-up, and drop-off locations) with Drivers to enable the scheduling and provision of Rides.

The laws of the domicile shall govern this policy and shall be used wholly in as far as there are no conflicts of laws. Should there be any conflicts, the policy will only change as far as the inconsistency with the laws of the domicile.
E. Notifications and Marketing
We will only contact you using your e-mail address and/ or phone number to send direct marketing messages if you have given us permission to do so via the website or via the App. We may personalize direct marketing messages using the data on how you use Showfa Services (frequency of use, journeys, payments).
If you no longer wish to receive direct marketing messages, please click the appropriate link in the footers of our e-mails or in the profile section of the Showfa App.
Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
SHOWFA Limited and its licensors do not warrant that:
1. the Service will function reliably and uninterrupted,
2. the security or safety of users at any particular time or location;
3. any errors or defects will be corrected;
4. the Service is free of viruses or other harmful components; or
5. the results of using the Service will meet your requirements.
G. Retention of Information
Your personal data given to us may be stored as long as you have an active user (Driver/Rider) account. If your account is closed either by Showfa Limited or the user, personal data will be deleted (according to the policies set out in this section) from the databases unless such data is required to be retained for accounting, dispute resolution, or fraud prevention purposes.
We will only retain your personal data for as long as reasonably necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, or reporting requirements.
We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation with respect to our relationship with you.
To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data, and whether we can achieve those purposes through other means, the need to comply with our internal policy and the applicable legal, regulatory or other requirements.
Anonymized information that can no longer be associated with you may be held indefinitely.
We are very concerned about safeguarding your information. We at Showfa employ all reasonable administrative, physical, and electronic measures designed to protect your information from unauthorized access, e.g., malware, phishing attacks, and viruses. We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored “personal data” (as defined in applicable state statutes on security breach notification) to you via email, text, or conspicuous posting on the Website in the most expedient time possible and without unreasonable delay, insofar as it is consistent with;
(i) the provisions of the governing laws on data protection.
(ii) All the ongoing measures used by Showfa to establish the level of breach and the restoration to reasonable integrity of the data system.
I. International Data Transfer
From time to time, we may need to transfer your personal information outside the Republic of Kenya.
Where we send your information outside Kenya, we will make sure that your information is properly protected in accordance with the applicable Data Protection Laws in the new jurisdiction the data may be exported.
